Terms & Conditions for Olive and Plum Limited

These Terms and Conditions outline the agreement between Olive & Plum Limited (“we”, “us”, or “our”) and any individual or entity (“you” or “participant”) who books an art retreat with us. By booking, you agree to these Terms and Conditions.

For the purposes of the Package Travel and Linked Travel Arrangements Regulations 2018, Olive & Plum Limited acts as the organiser of the retreat packages offered.

1. Booking and Payment

1.1 Booking Confirmation

A non-refundable deposit is required at the time of booking to secure your place.

The remaining balance is due 180 days before departure. Payments are non-refundable except where cancellation rights apply under these Terms and Conditions or under the Package Travel and Linked Travel Arrangements Regulations 2018.

1.2 Retreat Guarantee & Travel Arrangements (Important)

The retreat is only confirmed once the required minimum number of participants is met. You will receive written confirmation once this happens.

Please do not book flights, accommodation, or other travel plans until you receive written confirmation from us that the retreat is guaranteed.

Our responsibility is limited to the services included in the retreat package as described in your booking confirmation and in accordance with the Package Travel and Linked Travel Arrangements Regulations 2018. Flights, accommodation booked independently, and other travel costs are not covered.

We strongly recommend purchasing comprehensive travel insurance to cover any unexpected events.

If we cannot guarantee the retreat, you may either:

  • Transfer to another guaranteed retreat, or

  • Receive a full refund of all money paid.

Lundy Island bookings:
Travel to and from Lundy Island is via boat or helicopter and is weather dependent. If travel is not possible due to weather conditions, Olive & Plum Limited will arrange alternative accommodation until travel is possible, but the workshop itinerary may change as a result.

1.3 Payment Methods

Payments are processed securely via our website using the WeTravel booking platform.

Payment may be made via credit/debit card or bank transfer.

We do not charge credit card fees; however, a booking fee may apply and will be displayed at checkout.

1.4 Late Bookings

If booking within 180 days of the retreat start date, the full amount is payable immediately.

No refunds will be issued for participant cancellations except where statutory cancellation rights apply.

1.5 Financial Protection (ABTOT)

Olive & Plum Limited is ABTOT bonded (Association of Bonded Travel Organisers Trust).

This means that when you book a retreat package that includes accommodation or other travel services, your money is financially protected in accordance with the Package Travel and Linked Travel Arrangements Regulations 2018.

In the unlikely event of our insolvency, ABTOT provides financial protection for:

  • Refunds of payments made to us for any travel services not yet provided, and

  • Repatriation if your booking includes accommodation and transport and you are already on the retreat.

You will receive details of the financial protection applicable to your booking with your booking confirmation.
Claims should be made directly to ABTOT. Further information is available from ABTOT or on request from Olive & Plum Limited.

2. Cancellations and Refunds

2.1 Cancellation by Participant

The deposit is non-refundable.

The final balance must be paid 180 days before departure. Payments are non-refundable except where cancellation rights apply under these Terms and Conditions or the Package Travel and Linked Travel Arrangements Regulations 2018.

You may transfer your booking to another person in accordance with applicable law. An administration fee may apply.

We strongly recommend travel insurance to cover cancellations due to personal reasons, illness, or unforeseen events.

2.2 Cancellation by Us

We may cancel a retreat due to:

  • Insufficient participants, or

  • Unavoidable and extraordinary circumstances (including, but not limited to, natural disasters, pandemics, political unrest, government action, travel restrictions, or other events beyond our control that could not have been avoided even if all reasonable measures had been taken).

If we cancel, you may:

  • Transfer to another guaranteed retreat, or

  • Receive a full refund of all money paid.

If cancellation is due to unavoidable and extraordinary circumstances, refunds will be made in accordance with the Package Travel and Linked Travel Arrangements Regulations 2018. We will not compensate for additional costs such as flights or accommodation booked independently.

2.3 Refund and Transfer Options

Full refund where required by law if we cancel due to insufficient participation or unavoidable and extraordinary circumstances.

Transfer to another retreat, subject to availability and at no additional charge.

Future credit may be offered for use on a later retreat, valid for a specified period.

No compensation is provided for additional travel costs; travel insurance is strongly recommended.

2.4 Limitations of Liability

We are not responsible for additional expenses such as:

  • Flights, hotels, or transfers booked independently

  • Visa or vaccination fees

  • Non-refundable travel insurance costs

 

2.5 Unavoidable and Extraordinary Circumstances

If unavoidable and extraordinary circumstances occur, we will:

  • Notify participants as soon as reasonably possible

  • Offer refunds or alternative retreat options in line with the Package Travel and Linked Travel Arrangements Regulations 2018

We are not liable for losses resulting from such circumstances beyond those required by law.

2.6 Artist Availability and Substitution

If an advertised artist becomes unavailable due to unforeseen circumstances, a suitable replacement will be provided.

Artist substitutions do not entitle participants to a cancellation or refund.

3. What’s Included and Excluded

3.1 Included

  • Accommodation as per itinerary

  • Meals as per itinerary

  • Workshops and instruction

  • Local transfers at designated times

 

3.2 Not Included

  • Airfare

  • Transportation outside designated transfers

  • Art materials

  • Travel insurance

  • Personal expenses and optional activities

  • Tips

 

3.3 Excursions and Activities

Any additional activities booked separately are not our responsibility.

 

4. Your Responsibilities

 

4.1 Travel Documents

You are responsible for ensuring that your passport is valid for at least six months beyond your planned return date and for obtaining any required visas, travel authorisations, or health documentation.

Failure to secure appropriate travel documents may result in denied boarding or entry, and Olive & Plum Limited cannot be held liable for any resulting losses or costs.

 

4.2 Behaviour

Participants must act respectfully towards fellow participants and staff. Disruptive behaviour may result in removal from the retreat without a refund.

 

4.3 Health and Safety

You must declare any medical conditions, dietary requirements, and allergies at the time of booking and inform us of any changes prior to the retreat.

We cannot guarantee an allergen-free environment.

Participants must carry any necessary medications and appropriate insurance coverage.

 

4.4 Arrival Delays

We are not responsible for delays affecting your arrival. No refunds are given for missed portions of the retreat.

5. Changes to the Itinerary

We reserve the right to make minor changes to the itinerary due to unforeseen circumstances. No refunds will be issued for minor changes.

 

6. Liability and Waiver

We are responsible for ensuring that services included in your retreat package are delivered as described. If any element fails due to our fault or that of our suppliers, we will take reasonable steps to resolve the issue.

Any excursions or activities not included in the retreat package and booked separately are provided by independent third parties. Your contract for such activities is with the provider, and we are not responsible for their performance or safety.

Participation in retreat activities is at your own risk. We are not liable for personal injury, illness, loss, or damage unless caused by our negligence.

All participants must hold comprehensive travel insurance covering medical emergencies, cancellations, and adventure activities where applicable.

 

7. Intellectual Property

All retreat content, workshop materials, and media remain the property of Olive & Plum Limited and may not be used for commercial purposes without permission.

 

8. Privacy Policy

We collect only the information necessary for your booking. Your data will not be shared without your consent.

9. Governing Law

These Terms and Conditions are governed by English law.
Any disputes will be handled in the courts of England and Wales.

 

10. Travel Insurance Requirement

All participants must purchase comprehensive travel insurance covering medical emergencies, cancellations, and trip interruptions.

By booking a retreat with Olive & Plum Limited, you confirm that you have read, understood, and agreed to these Terms and Conditions.
